Abstract: | The author suggests that the new patent regime should provide protection on plant varieties in a way that fullfils the interest of the farmer and breeder under a system that safeguards the traditional knowledge on indigenous plants of commercial value. The transgenic plants/ products of biotechnology stokes no fear as they favour increased agricultural production while eliminating the difficulties encountered in agricultural practice. The regime may take into account the upstream patenting of gene sequence with novel traits and of technology with that of down stream protection of transgenic plant varieties under a united system. |
