| Abstract: | The paper discusses judicial decisions rendered on interpretation of offence of copyright infringement under Section 63 of the Copyright Act, 1957 in the backdrop of two recent conflicting decisions of the Andhra Pradesh High Court and the Kerala High Court on the same matter. The paper attempts to clear confusion, which has arisen post-Amarnath Vyas regarding cognizabilty and bailability of the offence of copyright infringement. The authors highlight intention of the legislature in enacting the Copyright (Amendment) Act, 1984 to argue that the decision of the Andhra Pradesh High Court is erroneous. |
